La loi organique de modernisation des règles applicables à l'élection présidentielle conforme à la Constitution: questions autour du contrôle de la "conformité de la loi organique aux observations du Conseil constitutionnel"

Abstract : «The electoral modernization package of April 25th, 2016», which includes two laws: Organic Law n ° 2016-506 for the modernisation of the rules applicable to the presidential election and Law No. 2016-508 for the modernisation of various rules applicable to elections; has implemented a reform long desired by the Constitutional Council and the independent administrative authorities involved in monitoring elections. If the measures in this reform (including the reform of equity - rather than equality - applied to the amount of speaking time given over to candidates during the so-called "intermdediate" period of their audiovisual campaign) were strongly criticised, especially by the «small» political parties; nevertheless, it is the decision of the Constitutional Council of April 21st, 2016, which deserves comment. Indeed, for the first time, it seems that the latter has cemented its observations as a new standard of reference, to be integrated in to the block of constitutional principles, on the subject of monitoring presidential elections. Can the Constitutional Council be both «advisor» and «censor»?
